Most likely a designer built these forms intentionally from requirements that tell him what elements need to be on each screen. It would be very simple to add an extra ‘opt out’ next to the opt in. It depends on how the aftermath is managed. The right will stop at absolutely nothing to basically canonize Trump after he’s gone and the left will be completely clueless about how to respond.
